In desperate need of help! For the past two years I have been having problems out of my now 14yr old son.  My older son was shot five times because, my 14yr old had a charlie horse and kicked dirt on a young man's pants while they were at a park. Since then he has been acting out. I have have went above and beyond trying to get help and conseling for him. He was on the honor role and started receiving failing grades because he refused to gto school. I have went as far as filing an ungovernable petition to have him court ordered to go to school, stay from certain places and so-called friends. As a mother of four young men I try to be firm, but fair. My requirements of my children are simple, go to school, keep your room clean, don't use drugs and Be a Something and Somebody instead of a Nothing and Nobody! On March 04, 2008 my 14 year old son was home after refusing to go to school. I then questioned him about being home once again. He then started yelling at me, saying that "he hate me", and telling me that "he will Knock me out"! I  threw a paint brush at him and  he balled up his fist and said that, "he will knock me out".After being threatned by my on child I called 911 and  I waited on the police.Once the police arrived one of the officers said that , "as a mother you have every right to discipline your children especially if they are rude and disrespectful". The officers then left and a female officer returned to tell me that she was training the other officer and he was wrong and that "I did not have a right to discipline". I was on the phone with my mother and I was telling her what the officer said. I explained to her that I work everyday and that My Children Must Abide By The Rules. She then told me to hang up the phone, but she never read me my rights or told me that she was placing me under arrest. I told her that "I did not do anything wrong". She then grabbed my arm and yelled for another officer, he came in and stomped on my foot and slapped me on my neck pulling me down the stairs. After falling down the stairs I was told if I did not put my hands behind my back they was going to taser me. They took me to the police station, although they never read me my rights. I told them that I needed medical care because I had no feeling in my toes and they were bleeding. I was taken to the hospital, once examined I had to get stitches in one of my toes and the other one was broken. I was then taken to PBSO Jail and booked on domestic battery on my son who was very disrespectful to me. Now I am on a leave from my job, because once release I was seen by two other doctors who refused to let me work due to foot, shoulder and lower back injuries I sustained from the Officers using excessive force.  All I want to do is be the best mother to my children. It's so much crime and gang activity where we live and I don't  want my kids to become apart of that. I am in need of some financial help or resources. Police Brutality Law--

When an individual government official, or other person acting under color of law, violates one's civil rights, such a violation may give rise to civil liability, under 42 U.S.C. § 1983. This statute allows a person to sue that individual -- and perhaps his government-employer in certain circumstances -- for money damages. Additionally, if successful on a civil rights claims, the law allows recovery of attorney's fees, under 42 U.S.C. § 1988.

Misbehavior by a government official or agency may well also give rise to "negligence" type claims. Many states have "governmental immunities" acts, "sovereign immunities" acts, "tort claims" acts, and the like. These statutes often outline the nature and extent of permissible claims against the particular governmental entity at issue -- oftentimes, a government agrees to "waive" immunity in certain situations, thus allowing a private citizen to sue on non-civil rights claims as well. Sometimes the statute will impose a monetary cap on recovery, or prohibit punitive (i.e., "punishment") damages, or require specific notice to be given within a specified period of time in order to permit one to bring such a claim. It is imperative, in every situation that possibly invoves police (or other governmental) liability, that you immediately consult with an attorney to determine the particular type of notice, if any, that must be given to the government. Frequently a failure to give such notice will bar absolutely any claims under the pertinent tort claims/sovereign immunity act.

Sometimes tragedies occur when a person who is incarcerated, whether pre-trial or post-trial, is assaulted by other inmates. Or perhaps an inmate has a particular problem that leads him to take his own life. These acts, too, may give rise to civil claims against government officials. When a government limits or restricts one's ability to act on his own behalf -- thereby creating what is known as a "special relationship" -- the law imposes upon that government the obligation to assume some responsibility for his safety and general well-being. This includes the obligation to provide things such as food, clothing, shelter, medical care and reasonable safety. The United States Supreme Court has repeatedly reaffirmed these obligations.

In my opinion, First, in a domestic situation the police have their right to decide who the agreesor is under the facts of bruising, physical marks, signs of scuffle, and additional clues that gives the police reasonable suspicion.

Contact your local police department to file a complaint against the officers. In addition, contact the Citizens Review Board about filing a complaint with them and contact the FBI to investigate your violation of your civil rights.

Your son does need counseling, especially if he doesn't have a father figure in the home. Please cruise through my aidpage and read about different forms of law and victimization that occurs around juveniles.
